The terms that apply when you use our website, buy a test kit or book a consultation with The Microbiome Clinic.

Five things a regulator should hear first.

  1. 01FitGut Pty Ltd trading as The Microbiome Clinic supplies medical consultations and arranges pathology tests through NutriPATH.
  2. 02Buying a test kit buys a laboratory test of your sample. It is not a diagnosis and it is not treatment.
  3. 03Results go to the person who bought the test. We forward them to a doctor only if you ask.
  4. 04Telehealth is for people in Australia, aged 18 or over, or under 18 with a parent or guardian present.
  5. 05Nothing here limits the Australian Consumer Law. Victorian law governs.

Who we are

FitGut Pty Ltd (ACN 673 059 786, ABN 32 673 059 786) trading as The Microbiome Clinic ("we", "us"), Level 2, 1 Hobson Street, South Yarra VIC 3141. Our doctors are registered medical practitioners regulated by Ahpra and the Medical Board of Australia.

What these terms cover

Use of themicrobiomeclinic.com.au, purchase of test kits from it, and booking of consultations. Your Privacy Policy, Collection Notice, Refund and Cancellation Policy, Telehealth and Informed Consent, and Website Medical Disclaimer form part of these terms.

Buying a test kit

  • What we offer: four test families: Gut (the Gut Microbiome Test, Complete, Max+, and the Kids and Baby tests), SIBO (the SIBO Breath Test), Oral (the Oral Microbiome Test) and Vaginal (the Vaginal Microbiome Test).
  • What you get: a sample collection kit, a pre-paid return satchel, laboratory analysis of your sample by NutriPATH, and a laboratory report.
  • What you do not get: a diagnosis, a treatment plan, or medical advice. A laboratory report on its own does not diagnose any condition. A doctor can interpret it in the context of your history.
  • Your doctor details. When you order, we ask for a doctor or clinic. If you do not have one, Self-Referred is a valid answer. We keep these details for our records, and use them to forward your results if you ask us to.
  • Results go to you, the person who bought the test. We forward them to a doctor only if you ask. If you would like your results explained, you can book a consultation, which is a separate service with its own fee.
  • Use-by dates. Kits must be used and returned by the date printed on the kit. Samples received after that date, or collected incorrectly, may be rejected by the laboratory. See the Refund and Cancellation Policy.
  • Eligibility. Tests are sold to people aged 18 or over. A test for a child (the Kids and Baby tests) may be bought only by the child's parent or guardian, who is responsible for collecting the sample and for the child's consent. Results go to the parent or guardian who bought the test.
  • We send test kits within Australia only. Shipping is set out in our Shipping Policy.

Consultations

  • Consultations are provided by telehealth (video or phone) Australia-wide, or in person at our South Yarra clinic.
  • Eligibility. You must be physically in Australia at the time of a telehealth consultation and be 18 or over, or be accompanied by a parent or guardian. The Telehealth and Informed Consent form must be accepted before your first consultation.
  • At a consultation the doctor advises on treatment or referral for your circumstances. Booking a consultation does not entitle you to a prescription or a particular outcome.
  • A discovery call is 15 min · no charge · no obligation. It is for practical questions about how the clinic works. It is not medical advice and no clinical assessment is made.

Prices and payment

  • Prices are in Australian dollars and include GST where it applies. GST does not generally apply to medical services.
  • Payment is taken at checkout or at booking through Shopify Payments or our booking system. We do not store card numbers.
  • We may change prices at any time. The price you pay is the price shown when you order.

Medicare and health funds

  • Only consultations with Dr Paul Froomes are claimable through Medicare. Consultations with our other doctors are not Medicare-claimable and are paid in full by you. Rebate amounts are set by Medicare and depend on your eligibility. We tell you before you book which doctor you are seeing and what the out-of-pocket cost is.
  • The pathology tests we sell are not Medicare-rebatable.
  • We do not promise a rebate, a bulk-billed service, or a health-fund benefit unless we confirm it in writing for your specific service.

Your obligations

  • Give us accurate information, including your identity, date of birth and current medications.
  • Follow the collection instructions in the kit.
  • Do not rely on our website instead of seeing a doctor. If you are unwell, see a doctor. In an emergency call 000.

Consumer guarantees and liability

  • Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law. Nothing in these terms excludes, restricts or modifies those guarantees.
  • Where the law permits us to limit liability for goods or services not of a kind ordinarily acquired for personal, domestic or household use, our liability is limited, at our option, to resupplying the goods or services or paying the cost of resupply.
  • We are not liable for delays or loss caused by Australia Post or the laboratory that are outside our control, except where the ACL says otherwise.
  • We do not limit liability for death, personal injury, fraud, or anything the law does not allow us to limit.

Website content

  • Content on the website is general information only. See the Website Medical Disclaimer.
  • We own or license the content. You may print it or keep a copy for personal use. You may not republish it.
  • We may change or remove content, products or services at any time.

Privacy

We handle your information under our Privacy Policy and the Collection Notice shown at checkout and booking.

Ending or suspending service

We may decline to supply a test or consultation where a doctor considers it clinically inappropriate, where an order appears fraudulent, or where a patient is abusive to staff. Any prepaid amount for a service not provided is refunded.

Changes to these terms

We may update these terms. The version on the website at the time you order or book applies to that order or booking.

Governing law

These terms are governed by the laws of Victoria, Australia. Disputes are subject to the courts of Victoria, and nothing prevents you from using the Australian Consumer Law or a consumer tribunal in your own state.
